MMHP Lease
Below you may view a copy of our residential lease. A "lease" is a legally binding contract between a landlord or rental group/agency and a tenant or renter. At MMHP our lease is a "month-to-month tenancy" meaning that our residents are not locked in to a lease for a set period before renewal. This allows us as the property owners and our residents to terminate a lease with a minimum 30 day notice as legally required by a month-to-month tenancy agreement.

SECTION 1: GENERAL AGREEMENT
(I) Definitions: MMHP = Landlord | Resident(s) = Renter(s) / Tenant(s)
(II) Lease Term: This lease is a "month-to-month tenancy" meaning our residential lease continues month to month automatically unless terminated by the resident(s) or MMHP management. Our residential lease will however require an annual renewal.
(III) Rent: Your current monthly rent is $000.00. Due on or before the 1st of the month. If rent is not paid by the 5th of the month, a $5.00 late fee for each day late (starting from the 1st) will be added to the monthly rent amount. If rent is not paid by the 10th of the month, an eviction process will begin.
(x) Checks or Money Orders MUST be made out to MOUNTAINEER MOBILE HOME PARK (MMHP) and can be deposited in the drop box beside the mailbox area at the entrance of the park. There will be a $25 fee for any returned checks.
(x) Cash can be left in the drop box or brought to the office from 5-8 pm, Monday-Friday.
(IV) Security Deposit: Upon approval of this lease, the resident(s) will pay $000.00 as a security deposit, which shall not bear interest, need not be kept separately, and shall be returned to resident(s) within 30 days of the peaceful termination of this lease. Cost of any damages or unpaid rent will be deducted from this security deposit, if applicable.
(V) Relocation: A 30-day notice will be given before removing the mobile home from the park; the same will apply for eviction from the park. After 30 days, any mobile home left empty and delinquent on rent will be considered abandoned and legally become the property of MMHP.
(VI) Sub-Leasing: Mobile homes CANNOT be rented by another individual while it is located on MMHP property. Mobile homes sold or transferred to another individual must be reported to MMHP management, this will allow us to work with the new owner on becoming a resident of MMHP and completing a criminal background check or otherwise allow us to prepare for the mobile home to be relocated.
(VII) Additional Resident(s): Each mobile home is a SINGLE family dwelling. Visitors are welcome however individuals who reside in your residence longer than two(2) weeks (14 days) will be required to be added to your residential lease.
(VIII) Sanitation Service: Trash service to individual homes is required by the State of West Virginia and Wood County Code Enforcement. All trash must be put to the curb on Wednesday for pick-up. NO trash is to be placed on the ground (in trash bags) at any time. This is a code violation and you will be written up for this.
(IX) Lots/Spaces: Each resident is responsible for their own lot, driveway, and porch area. This means the grass must be mowed/trimmed, free of rubbish, no bagged garbage, etc. Each home is to have skirting installed within 1 month after moving into the park, and must be maintained as long as the home remains in the park. Lots, driveways, and porches are to be neat/clean at all times.
(X) Landlord's Right to Entry:
Landlord shall have the right to enter the premises (meaning the lot/space, not the home) at all times which are necessary to make needed repairs and to inspect for water/sewage/gas leaks. The right shall exist whether or not resident(s) or other occupant(s) are on the premises at such time.
Landlord shall also have the right to enter resident(s) home to inspect for water/gas leaks, only when resident(s) is present.
Landlord shall have the right to inspect homes exterior/premises
Resident(s) agrees to make all repairs, replacement, or deficiency noted within the time set by the Landlord.
(XI) UTILITIES: Resident(s) are responsible for all fees and inspections necessary to hookup utilities and electricity to their mobile home. Resident(s) is responsible to maintain utility lines from ground level up to and including inside the mobile home. Upgrades to the electric pole or electric service are the sole responsibility of the resident(s). 100 amp service is provided to all lots/spaces in MMHP, however resident(s) may upgrade the service if they wish and after obtaining approval from MMHP. The upgrade cost is the resident(s) responsibility.
All charges incurred by MMHP as a result of damages or blockages caused by the resident(s) will be charged to the resident(s).
(XII) Interruption of Service: Interruption or failure of any service provided and maintained by MMHP for the premises, if due to causes beyond MMHP's control, shall not entitle resident(s) to any claim against MMHP or to any reduction in rent.
(XIII) Release of Liability: The Landlord shall not be held liable for any damage or injury which may be sustained by resident(s) or any other person, as a result of the failure, leakage, breakage, or obstruction of the water, sewage, or drainage pipes; or the electrical, gas, or oil system; or by reason of the elements; or resulting from the carelessness, negligence, or improper conduct on the part of any other resident(s) or other resident(s) agents, guests, licensees, invitees, assignees, or successors.
(XIV) Fire & Casualty: If the resident(s) property and or premises are damaged by fire or other casualty, (MMHP will determine if home is beyond repair) Resident(s) shall repair the damage to the standard MMHP agrees upon with the resident(s) or the home will be removed within thirty (30) days and rent will not be abated for such period of time. Resident(s) agrees to release MMHP from any and all claims for loss, damage, or inconvenience arising from such fire or casualty.
(XV) Animal & Insect Removal: Resident(s) are responsible for keeping premises free of all animals, including cats (that are not inside pets approved by the Landlord). If insects or animals become a problem or annoyance, resident(s) are responsible for the safe removal of animals and/or extermination of insects. In the event of an animal hording situation please contact MMHP management immediately. Animal hording is defined as possessing/maintaining or otherwise attracting more animals than you can provide adequate shelter, food, and veterinary care. Animal hording will result in eviction from MMHP.
(XVI) Pets: NO OUTSIDE DOGS! All dogs are to be kept indoors. Dogs cannot be tied outside or left unattended, EVER. Dogs are to be on a leash when in the park and the owner is responsible for cleaning up after their pet (yards, street, driveway, neighbors yards). All dogs must be licensed in Wood County. Owners are responsible for any damages or injuries caused by their pets.
(XVII) Children: Parents are responsible for their own children. Children must play in their own yards unless permission is given by neighbors for them to be playing in their yard. Children are not allowed to climb on any of the trees in the park or to play in the road. If you have outdoor play equipment, you are responsible for those playing on your equipment. No pools or trampolines are permitted in the park.
(XVIII) Speed Limit: Speed limit in the park is 10 MPH. The park road is a private road, owned and maintained by MMHP. Please alert visitors to the posted speed limit. Any violations of the speed limit may result in eviction.
(XIX) Noise: Noise should be at a minimum at all times. This includes loud music, barking dogs, screaming children, or racing engines. After 10 PM, it is to be quiet.
(XX) Illegal Drugs: No drugs. Illegal Drugs will not be tolerated in the park. Use or sale of drugs will be automatic, immediate, and permanent eviction from MMHP.
(XXI) Vehicles: There is space to park 2 vehicles at each lot/space. No junk, unlicensed, or parts vehicles are allowed in the park. Vehicles that do not run must be removed from the park immediately. No major mechanic repair work is to be done in the park. Motorcycles are to obey the same rules as vehicles. ATV's are not to be ridden in the park.
(XXII) Safety: For the safety and consideration of other residents, NO BURNING is permitted in the park. Fire pits may be permitted with MMHP approval. Damage or injuries caused by a fire pit will be the resident(s) responsibility.
(XXIII) Violations: Residents will be given two warnings for any violations of this lease or the rules & regulations. After the 2nd warning/write up, the eviction process will begin. This includes late rent payments, noise issues, garbage or lot maintenance issues, speeding issues, etc.
(XXIV) Default Clause: If the resident(s) shall fail to pay the rent or any other fee required to be paid by resident(s), or if resident(s) shall breach any of the terms of this lease, MMHP reserves the right to terminate this lease with a minimum 30 day notice. At such time, resident(s) will be required to surrender possession of premises (Lot/Space) to MMHP, as set forth in 37-6-5 and any other provisions of the West Virginia Code. The resident(s) agrees that in no way will MMHP be responsible for any damages incurred by entering said premises or removing or storing resident(s) property. The resident(s) shall be responsible for any legal costs suffered by MMHP in the enforcement of any provision of this lease.
(XXV) Rental Agreement/Holding Over: Lots are rented on a monthly basis and this agreement is in effect until the resident(s) or MMHP gives a 30-day written notice of termination/eviction. At the end of the term of this lease, resident(s) may remain in possession of the premises with MMHP's permission, with all provisions in this lease remaining in full force and effect. MMHP reserves the right to increase rental payment, adjust new rules & regulations, require resident(s) to sign a new lease/renew lease, or make alterations to any other term, condition, rule, or regulation of this lease with a thirty (30) day notice.
SECTION 2: RULES AND REGULATIONS
Resident agrees to abide by and observe all of the following rules and regulations. Resident(s) are responsible for notifying visitors to their home of these rules and regulations. If Resident(s) visitors fail to abide by said rules and regulations, such violation will be considered as a default under this lease and subject to eviction.
Resident is to park vehicles only on the space provided with each lot. No parking in the road or on the grass.
Operation of unlicensed motorized vehicles is strictly forbidden.
All cars, trucks, trailers, etc. are required to be operational and have current licenses and inspections.
No vehicles larger than a one-ton truck are permitted in MMHP.
Campers, boats, school buses, and trailers must have permission from the Landlord to be parked on the property.
Only minor vehicle repairs are permitted to be completed in the park (oil change, light bulb change). Absolutely NO major vehicle repairs are permitted (engine repairs, engine rebuilds, etc.)
Any vehicle leaking fluid will be removed at the owner's expense.
The speed limit is 10 MPH.
Trespassing on another Resident’s lot is prohibited without permission of said Resident, except for the park Landlord or maintenance man.
The lot and parking area are to be kept free of litter and debris. ALL REFUSE IS TO BE STORED IN COVERED CONTAINERS and placed out at the road, no earlier than one day prior to pick-up. No refuse of flammable materials is to be stored on premises. Landlords must have access to water/sewage connections.
Suitable heat tape wrapping and insulation the entire length of the water line from ground connections to the home must be installed and plugged into a live G.F.I. socket from Oct. 1 to April 1 each year. Landlord is not responsible for repairs or damages to the home/premises that are caused by frozen water pipes.
Excessive water use is prohibited. No swimming pools, watering of lawns, flower beds, or washing of vehicles is permitted. Any leaks from the home will result in water being shut off until leaks are repaired.
ALL HOMES ARE REQUIRED TO DISPLAY LOT NUMBERS VISIBLE FROM THE ROAD.
Children are to be under the supervision of an adult at all times.
Resident’s are responsible for the actions of their family and guests. Any damage caused by family and/or guests will be paid by the Resident(s).
Bow and Arrows, BB guns, slingshots, paintball guns, any firearms, and all fireworks are forbidden to be used in the park.
Homes must be completely enclosed with approved skirting, no later than thirty (30) days after occupancy. NO CONCRETE BLOCKS are permitted to be used as steps. All decks must be built to Wood County Code specifications and approved by the landlord.
Grass is to be mowed and trimmed as needed. Grass that is more than four (4) inches in height must be mowed and/or trimmed as needed. Grass that is more than four (4) inches in height will be mowed/trimmed by the Landlord/maintenance man at a charge of $50.00 per mowing/trimming. Landlord will not be responsible for any damage caused by Landlord/maintenance man’s mowing/trimming of grass.
Tree limbs on your lot that are affecting your home entrance or hitting your roof are your responsibility to trim. Cutting trees down or planting new trees is only permitted with prior approval from the landlord.
No business is to be conducted from the home without Landlord’s permission.
No concrete or asphalt walks or slabs are to be constructed. Deck posts, etc. are not to be concreted in the ground.
Resident’s are required to keep current information on file at the park office, including (but not limited to) resident’s names, home and emergency numbers, vehicle descriptions, vehicle license plate numbers, and proof of ownership.
The surrounding woods and property are off limits without the consent of the Landlord.
No dumping of any kind (toxic substances, refuse, junk, etc.) is permitted on the property.
No political signs are to be placed on premises.
All electrical work performed on home, buildings, or anywhere on premises must be inspected by a certified electrical inspector.
Resident’s are required to have trash ready for pickup by Waste Management every Wednesday. Storing of trash will not be tolerated
No trampolines permitted.
No fences are permitted without written permission from the Landlord.
No additions to home allowed without permission.
Auto radios must be turned down while in MMHP.
No drunkenness, immoral conduct, disturbing of other Residents, threats, harassment, or abusive language will be tolerated.
If any checks are returned for non-payment, future payments must be made by money order or cash.
Any vehicle not licensed, cannot be moved on its own power, or is not legal to be driven on the roads of West Virginia may be towed from MMHP, by the Landlord at owner’s expense.
